1. Acceptance of Terms

By accessing or using the Apni Angithi food delivery application ("the App"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our services.

Important: These terms constitute a legally binding agreement between you and APNI ANGITHI PRIVATE LIMITED.

2. Account Registration

  • You must be at least 18 years old to create an account
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these terms

3. Ordering and Payment

Order Placement

  • All orders are subject to acceptance by the restaurant
  • Menu prices are set by restaurants and may change without notice
  • We display the final price inclusive of all taxes and charges
  • Minimum order values may apply depending on the restaurant

Payment Terms

  • We accept various payment methods including credit/debit cards, UPI, and wallets
  • Payment processing is handled by secure third-party providers
  • All payments are final unless otherwise required by law
  • Refunds, if applicable, will be processed within 5-7 business days

4. Delivery Services

  • Delivery times are estimates and not guaranteed
  • Delivery charges are determined based on distance and restaurant policies
  • You must provide accurate delivery address and contact information
  • If you're unavailable at delivery time, our delivery partner will attempt to contact you
  • We are not liable for delays caused by factors beyond our control

5. Cancellation and Refund Policy

Cancellation by Customer

  • Orders can be cancelled before restaurant acceptance
  • Once accepted by restaurant, cancellation may not be possible
  • Late deliveries do not qualify for automatic cancellation

Refund Eligibility

  • Wrong items delivered (with proof)
  • Significant quality issues (reported within 30 minutes of delivery)
  • Unauthorized transactions on your account
  • Technical errors causing duplicate charges

Non-refundable: Minor preparation variations, personal taste preferences, or delays under 30 minutes generally do not qualify for refunds.

6. User Conduct and Restrictions

You agree not to:

  • Use the App for any illegal purpose
  • Harass, threaten, or abuse our staff, restaurant partners, or delivery personnel
  • Place fraudulent orders or use stolen payment methods
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the App to transmit viruses or malicious code
  • Create multiple accounts to abuse promotions
  • Impersonate any person or entity

7. Intellectual Property

All content, features, and functionality of the Apni Angithi App, including but not limited to text, graphics, logos, images, and software, are the exclusive property of APNI ANGITHI PRIVATE LIMITED and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of our App without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, APNI ANGITHI PRIVATE LIMITED shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Food quality issues (restaurants are responsible for food preparation)
  • Delivery delays due to traffic, weather, or other external factors
  • Personal injury or property damage arising from food consumption
  • Errors in menu descriptions or pricing

Our total liability shall not exceed the amount paid by you for the specific order in question.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms and Conditions
  • Fraudulent activity
  • Abusive behavior towards our team or partners
  • Repeated order cancellations without valid reason
  • Violation of applicable laws

10. Dispute Resolution and Governing Law

  • These Terms shall be governed by the laws of India
  • Any disputes shall be subject to the exclusive jurisdiction of courts in Gurgaon, Haryana
  • We encourage users to contact us first at apniangithi@gmail.com to resolve any issues
  • Disputes shall be resolved through arbitration if mutually agreed

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via the App or email. Continued use of the App after changes constitutes acceptance of the revised Terms.
